0.1 These general conditions (the “General Conditions”), together, where applicable, with the particular conditions that may be established (the “Particular Conditions”), will regulate the access, use and the commercial relations between the user (the “Client”) and the majorica.com Point of Sale (“Majorica Online Store”) through which the Client formalizes the purchase of the products offered during their period of availability (the “ Products”) through the marketing platform accessible on the website www.majorica.com (the “Online Store”) owned by MAJORICA INTERNACIONAL, S.L., with NIF entity of Spanish nationality with NIF B-01906163 and with registered office in C/Argenters 77 07500 Manacor (Balearic Islands). The company is registered in the Commercial Registry of the Balearic Islands in Volume 1,544, Sheet PM-28,901 registration 8.

0.2 These General Conditions will remain in force and will be valid with the content in which it is published at any time in the On-Line store majorica.com. Majorica reserves the right to modify at any time both the General Conditions and the Specific Conditions (the ""New Conditions""), as well as all notices, guidelines and/or other regulations of legal content published in the Online Store and that , depending on the case, will replace, complete and/or modify the General Conditions contained herein. The Client will be subject to the General Conditions and Specific Conditions and other development regulations in force at the time of formalizing their purchase. Their temporary validity coincides with the time of their publication and until the moment in which they are totally or partially modified. The New Conditions will be applicable from the moment of their publication in the Online Store.MAJORICA INTERNACIONAL, S.L. recommends periodic consultation of the General Conditions, Specific Conditions and other regulations. 0.3 In case of contradiction between the terms and conditions stated in these General Conditions and the Specific Conditions, the latter will always prevail with respect to those incompatible terms, and only with respect to those products subject to said specific conditions.

0.4 The Points of Sale have Complaint Forms available to the consumer in the establishment.

1. INTERVENERS.

1.1 Consumers who are natural persons residing in the Spanish peninsular and insular territory (with the exception of Ceuta and Melilla and the Canary Islands) or in the territory of the European Community ( except territories excluded from the sale), who are of legal age or legal entities that adequately prove their condition and accept these General Conditions and the Specific Conditions that, where applicable, are applicable. The purchase of Products in the Majorica Online Store by minors, or by users who do not meet the requirements set forth in these General Conditions, is expressly prohibited.

1.2. The “Point of Sale” will be the entity that owns the establishment that the Client has chosen when formalizing their order, and will be the one with whom it will be understood to have been concluded. the purchase and sale of the requested Products. The corporate data of each of the Points of Sale responsible for the sale will be duly identified during the contracting process. MAJORICA INTERNATIONAL, S.L. only recognizes as authorized Points of Sale those that are duly identified as such in the Online Store and declines all responsibility for contracts made with establishments that are not identified as such authorized Points of Sale.

2. ACCESS AND USE OF THE ONLINE STORE.

2.1 Access and use of the Online Store is free of charge, with MAJORICA INTERNACIONAL, S.L. the power to demand compensation for access and use in the future.

2.2 To purchase the Products through the Online Store, Majorica will ask users to proceed to register, for which said Clients must complete the electronic form that at any time appears in the Online Store following the instructions indicated therein. In this registration process, accurate and true data must always be provided.

2.3 Majorica will send confirmation of registration to the email account that the Client has designated for this purpose. The username and password are enabling elements to access and make purchases and are confidential, personal and non-transferable. The username cannot be modified by the Client, but the password can, in which case the modified keys will lose their validity.

The Client will be responsible for the proper custody and confidentiality of the password, and may not transfer its use to any third party, whether temporary or permanent, nor in any case allow its use by any third party. The Client must immediately notify Majorica of any access to the Online Store that any third party other than the Client could achieve using their password.

2.4 All purchases of Products purchased through the Online Store, prior identification and authentication, through the username and password provided, will be considered validly made by the Client. , and will be binding. Consequently, the Client will be exclusively responsible for any purchases of Products through the Online Store by any third party that uses their username and password. The placing of orders from the Online Store by a minor who falsifies the registration information will be understood to be carried out under the supervision and authorization of his or her parents, guardians or legal representatives.

2.5. The use of the Online Store and/or the contracting of any of the Products implies acceptance as a Client, without reservations of any kind, to each and every one of the General Conditions as well as, where applicable, the Specific Conditions and other detailed regulations that, where applicable, are applicable. If you decide not to accept these General Conditions, the Specific Conditions and/or, where applicable, the New Conditions, you must refrain from accessing and/or using the Online Store. The making available and use of the Online Store by the Client will be understood, in any case, subject to strict compliance by the Client with the terms included in these General Conditions and, where applicable, in the Specific Conditions that are applicable.

2.6 The legal relationship derived from registration as a Customer of the Online Store has an indefinite duration. Any of the parties may terminate or suspend this contractual relationship unilaterally at any time and without any cause other than their will in this regard, without prejudice to the obligations derived from the formalization of orders prior to the termination of the relationship. The Client may unilaterally exercise the right of termination through the account cancellation process.
 

3.INFORMATION AND AVAILABILITY OF THE PRODUCTS OFFERED.

3.1. The Products offered in the Online Store, along with their essential characteristics and price, will appear on the screen. Apart from the price, and before confirming the order, the total shipping costs to the Customer's home will appear on the screen. The offers will be duly indicated on the screen. The Majorica Online Store reserves the right to decide at any time the Products that are contained and offered to Customers through the Online Store. In this way, the Majorica Online Store may at any time add new Products to those included in the Online Store, it being understood, unless otherwise provided, that such new Products will be governed by the provisions of the General Conditions in force at that time. . Likewise, the Majorica Online Store reserves the right to withdraw or stop offering, at any time, and without prior notice, any Products offered in the Online Store.

3.2. Promotional gift products, which are offered for the purchase ticket amount, will be charged and deducted from the ticket in case of Return: - if the amount of the final purchase ticket, after the return, does not meet the minimum amount conditions of the promotion, and the promotional gift is not delivered in the collection process to make the required and processed return effective. 

- If a full refund of the purchase is requested and such gift is not delivered along with the rest of the items. The amount of the promotional gift will be deducted from the total amount of the purchase for which the refund is claimed. 

3.3. Only one order for a maximum of ten (10) units of the same product may be placed for each purchase transaction. All orders and purchases made through the Online Store are subject to the effective stock availability of the Products, once you go to collect them in the Majorica Online Store that was indicated when formalizing the order or at the time the one that prepares its issuance for shipment.

If any of the Products in your order are not available, the Majorica Online Store will contact the customer to inform them, and they can choose between receiving the order with the available products or canceling the entire order.
 

4. PRICES AND SHIPPING COSTS.

4.1. The prices of the products are always shown in euros and include VAT and any other tax that may be applicable, and will at all times be the current. If Majorica or the Majorica Online Store identify a manifest error in the price of the Products, they will inform the Customer and the Customer will have the option of reconfirming their order at the correct price or, failing that, canceling it.

4.2. The price of the product does not include shipping costs. These expenses are the responsibility of the Client and will be added to the total amount of the selected Products. The cost of the contracted delivery service will be determined by the conditions and modality of said service selected. The Client will be duly informed of these costs, which will be duly broken down prior to making payment before confirming the order and finalizing the contracting process.

4.3. The prices shown in the Online Store apply exclusively to the Products offered through said Channel and for the time they remain published. Majorica and the Points of Sale expressly reserve the right to modify prices at any time without prior notice. However, in any case, the current rates indicated in the Online Store at the time of placing the corresponding order will apply. The prices published in the Online Store may differ and be different from the prices of the same Products offered and sold in the establishments of the Majorica distribution network to be purchased in said establishments directly.
 

5.PURCHASE PROCESS.

5.1. Once the Customer has registered, and to proceed with the purchase of Products, they must add the product they wish to purchase to the Shopping Cart, according to the instructions on the screen, for these purposes, completing the order form provided.

5.2. Once the purchase has been made, the Client will be sent, to the email address indicated for this purpose by the Client, a confirmation of the purchase made, which will serve as proof of the “Proof of Purchase” operation. Likewise, the Client may request the sending of the corresponding invoice. The order confirmation and Proof of Purchase will not be valid as an invoice.

5.3 The purchase will be deemed to have been made at the address of the Point of Sale.


6. METHOD OF PAYMENT.

6.1 To proceed with the payment, the Client must follow each and every one of the instructions shown on the corresponding page of the Online Store. Payment of the price of the Products and shipping costs may be made using credit or debit cards or other payment methods indicated at any time on the corresponding page. These means of payment will be subject to verification and authorization by the issuing entities, but if said entity does not authorize the payment, the purchase procedure initiated cannot be continued, the order being automatically cancelled, and the purchase and sale of the item being deemed not to have been carried out. Product or Products requested. The price of the Products, the costs of the shipping service -if applicable-, as well as any applicable taxes, will be charged at the time of formalizing the order.

6.2. As an electronic payment system, Majorica and the Majorica online store have an e-commerce payment gateway installed. All data provided to Majorica and the Majorica online store for these purposes are encrypted to guarantee maximum security. They are hosted on a secure server certified according to the ""Secure Socket Layer"" protocol. Under no circumstances will the data provided by Clients be stored through the payment gateway, and will only be kept while the purchase is made, the payment is made and until the withdrawal period has elapsed.

6.3. Majorica and the Majorica online store reserve the right to cancel the username and password, and therefore access to the Online Store, of those users who maintain balances debtors or unpaid with any Point of Sale.
 

7. COLLECTION AND DELIVERY OF PRODUCTS.

7.1. Home Delivery, delivery will be made, in general, between one and three working days from the confirmation of the order, at the address postcard that has been included in the order details, in any case within a maximum period of 30 days from confirmation of the purchase, except in the case of force majeure. The Proof of Purchase will be sent along with the Product or Products. MAJORICA INTERNATIONAL, S.L. will inform the Client of the logistics system used in each case for the delivery of the order, being outside of MAJORICA INTERNACIONAL, S.L. the traceability control that the logistician can offer to its recipients to control the delivery process.


8. WITHDRAWAL OF ORDERS.

The User has the right to withdraw from the purchase made through the Online Store, and therefore, if they are not satisfied, and provided that the nature of the purchased good allows it, they may return the Product within a period maximum of fourteen (14) calendar days from the delivery of the order to the address you have indicated to us. For this purpose, the User must request the return through the corresponding form on the website.

The refund of the purchase amount, when applicable, will be made in the same payment method with which the Product was purchased, discounting the costs of transportation and return that will be borne by the customer.


In any case, for the purposes of making use of the right of withdrawal, it is essential that the Products are in perfect condition. The products must be returned in their original packaging along with the invoice. Before returning the Product, the Customer must ensure that it is properly protected and sealed so that it does not suffer any damage during transport.

If the product is defective, Majorica will be responsible whenever possible to replace the product, at no expense to the Customer. If the product cannot be replaced for reasons of availability, a full refund of the purchase will be made.
 

9. GUARANTEES.

When the Product or Products purchased present a lack of conformity because they do not correspond to the characteristics offered, present defects that prevent their normal use in accordance with their nature, or do not offer the benefits described for them, the Client will have the right to sanitation of the acquired property within a period of three years from the purchase and under the conditions and with the means of proof regulated in the Revised Text of the General Law for the Defense of Consumers and Users, without prejudice to the powers of the Majorica Online Store to verify the veracity of the defects, their origin and the time of their appearance. In any case, the Customer must request the collection of the product from the Majorica Online Store within a maximum period of two months from the discovery of the defect, and must inform of the nature of the problem, the time and conditions of its appearance. Likewise, the Client has the right to clean up the property following the rules of article 118 et seq. of the Revised Text of the General Law for the Defense of Consumers and Users. In any case, the regulations established by the applicable legislation on the guarantee of sale of consumer goods at all times will be applied.
 

10.AFTER-SALES SERVICE. 

All repairs covered by the INTERNATIONAL WARRANTY CERTIFICATE are the responsibility of MAJORICA INTERNACIONAL, S.L.

Majorica will carry out the re-lining, change of closure, or any repair not covered by the warranty, for the fairest price, provided that the duly completed INTERNATIONAL WARRANTY CERTIFICATE is presented. 
They will not be carried out. substantial modifications to the original designs. 
The plating of the piece will not be changed if it does not exist as such. 
No transformations will be made to pearl necklaces and bracelets. 
Shipping Repairs to Majorica will be borne by the consumer.

All repairs covered by the WARRANTY, properly completed, will be repaired immediately. In this case, the return transportation costs are borne by MAJORICA INTERNACIONAL, S.L.

Any other special repair not covered by the WARRANTY must be specifically requested by email, and will be budgeted once the relevant study has been carried out. In this case, the return transportation costs will also be borne by the consumer. MAJOLAPERLA, S.L.U. reserves the right to refuse repairs that are not possible due to the characteristics of the Product

11. RELEASE OF LIABILITY.

MAJORICA INTERNACIONAL, S.L. does not guarantee the technical efficiency of the operating system of the Online Store, and is not responsible for any damages that may be caused to the Client due to failures or interruptions of the service that limit or prevent the availability or use of the Online Store.
The Online Store is protected with the most advanced means at all times against viruses and unauthorized access and therefore MAJORICA INTERNACIONAL, S.L. will only be liable for the damages caused to the Client by these actions insofar as they cause deficiencies in the normal standard of protection required at all times according to the state of the art.

12. PROCESSING OF PERSONAL DATA.

The personal data provided to MAJORICA INTERNACIONAL, S.L. due to the use of the Online Store are included in a File for which MAJORICA INTERNACIONAL, S.L. is responsible and which complies with the requirements established in the Data Protection legislation. of a Personal Nature. This File is registered in the General Registry of the Spanish Agency for the Protection of Personal Data. The Points of Sale have the legal consideration of those in charge of the Processing of these Personal Data and the communication of these Personal Data does not have the legal consideration of communication or transfer but rather of simple access to them for the purpose of the commercial transaction in the scope of the Online Store.
The processing of personal data by the Majorica Online Store, as well as any other information requested for access and use of the Online Store, will be governed by the provisions of the site's Privacy Policy. Website www.majorica.com.

13. GENERALITIES.

These conditions have been published in due time, in accordance with current legislation. Likewise, Majorica makes these General Conditions, the Specific Conditions, the New Conditions and other development regulations available to users, so that they can be stored and reproduced, thus complying with the legal duty of prior information.

MAJORICA INTERNACIONAL, S.L. reserves the right to modify, at any time, and without prior notice, the presentation and graphic and technical configuration of the Online Store, its functionalities and/or the contents incorporated therein. The user expressly acknowledges and accepts that at any time Majorica may interrupt, deactivate and/or cancel access and/or use of the Online Store, without Majorica being responsible for it.

In the event that any provision or provisions of the Purchase Conditions in the Online Store, General, Particular or development regulations were considered null or inapplicable, in whole or in part, by any Court, Tribunal or administrative body competent authority, said nullity or non-application will not affect the remaining provisions. In this case, the affected clause or clauses will be replaced by another or others that have the effects most similar to those of the replaced ones.

14. APPLICABLE LEGISLATION.

These Conditions have been prepared in accordance with the provisions of Law 34/2002, on information society services and electronic commerce, Law 7/1998 on General Contracting Conditions, Royal Decree 1906/1999. which regulates telephone or electronic contracting with general conditions in development of article 5.3 of Law 7/1998, Organic Law 15/1999 of December 13 on Protection of Personal Data, Royal Legislative Decree 1/2007 , of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Customers and other complementary laws, Law 7/1996 on the Regulation of Retail Trade, Royal Decree-Law 14/1999 regulating of the Electronic Signature and any legal provisions that may be applicable.
